Terms and Conditions of Service

Welcome to "misPelis" (the "Application"). These Terms and Conditions ("Terms") govern the use of our mobile application and any related services provided by misPelis (hereinafter, "we", "our").

By downloading, installing or using the Application, including creating a user account or subscribing to premium services, you agree to be bound by these Terms. If you do not agree with any part of the terms, you will not be able to use our services.

1. Acceptance of Terms

By using the Application, creating a user account or subscribing to our services, you confirm that you have read, understood and agreed to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and us.

2. User Accounts

The Application allows you to create optional user accounts to access additional features such as data synchronization across devices.

Account Creation: When creating an account, you agree to provide accurate and complete information. It is your responsibility to maintain the confidentiality of your login credentials.

Account Data: When creating an account, we store your email address, and data related to watched movies and achievements obtained. You can delete your account and all associated data at any time from the application settings.

Responsibility: You are responsible for all activities that occur under your account. You must notify us immediately if you detect any unauthorized use of your account.

3. License to Use (EULA)

We grant you a limited, non-exclusive, non-transferable and revocable license to use the Application for your personal and non-commercial use, subject to these Terms. You may not:

• Modify, decompile, reverse engineer or disassemble the Application.
• Rent, lease, lend, sell, redistribute or sublicense the Application.
• Use the Application for any illegal or unauthorized purpose.

4. Subscriptions and Payments

The Application offers premium paid subscriptions ("Subscriptions") that unlock additional features and remove advertising.

Subscription Management: We use RevenueCat as a third-party provider to manage, process and administer the subscription service within the application. By subscribing, you also agree to RevenueCat's terms of service.

Billing: If you purchase a Subscription, payment will be processed through the platform from which you downloaded the Application (Apple App Store or Google Play Store). You agree to comply with their respective terms of service. RevenueCat facilitates the connection between our application and these payment platforms.

Automatic Renewal: Subscriptions automatically renew for the same period of time at the end of each subscription period, unless automatic renewal is disabled at least 24 hours before the end of the current period.

Cancellation: You can manage and cancel your Subscriptions by going to your account settings on the app store platform (App Store or Google Play) after purchase. Cancellation will apply to the next subscription period. Subscriptions managed through RevenueCat will remain active until the end of the paid period.

Refunds: Unless required by applicable law, payments are non-refundable and no refunds or credits are granted for partially used subscription periods. To request a refund, you must contact Apple or Google directly depending on the platform from which you made the purchase.

5. Intellectual Property

The Application and its original content, features and functionality are and will remain the exclusive property of misPelis and its licensors. The Application is protected by copyright, trademark and other laws of Spain and foreign countries.

6. User Conduct

You agree not to use the Application to:

• Violate any local, state, national or international law or regulation.
• Transmit any material that is illegal, harassing, defamatory, abusive, threatening, harmful or that infringes the rights of others.
• Attempt to gain unauthorized access to our computer systems or engage in any activity that disrupts, diminishes quality or interferes with the performance of the Application.

7. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use and protect your personal information, including your user account data. By using the Application or creating an account, you agree to the collection and use of information in accordance with our Privacy Policy. You can consult it here: Privacy Policy.

8. Termination

We may terminate or suspend your access to our Application and your user account immediately, without prior notice or liability, for any reason, including, but not limited to, if you breach the Terms. Upon termination, your right to use the Application will cease immediately. You may also delete your account at any time from the application settings.

9. Disclaimer of Warranties and Limitation of Liability

The Application is provided "AS IS" and "AS AVAILABLE". We do not guarantee that the Application will be uninterrupted, secure or error-free. To the maximum extent permitted by applicable law, in no event shall misPelis be liable for any indirect, incidental, special, consequential or punitive damages resulting from your access to or use of the Application.

10. Applicable Law

These Terms shall be governed and interpreted in accordance with the laws of Spain, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Application after such revisions take effect constitutes your acceptance of the new terms.
